Visiting conditions
All visitors are bound by the visit conditions below. The Muiderslot will, within reason, do everything possible to ensure that the visit to the museum complex and the activities organized by the Muiderslot proceed as desired by the visitors. In addition, the Muiderslot will make every effort to keep any nuisance or inconvenience to the visitor to a minimum, as well as to ensure the safety of the visitor as much as possible.
These Muiderslot Visiting Conditions have been established by the director of Rijksmuseum Muiderslot and filed on June 1, 2019 with the Gooi- en Eemland Chamber of Commerce in Hilversum.
1. Definitions
1.1
‘Rijksmuseum Muiderslot Foundation’ (hereinafter referred to as ‘Muiderslot’) means the organization that manages and operates the museum complex, such as the management, educational staff, curators, attendants, tour guides and other museum officials authorized to act on behalf of this organization.
1.2
‘The museum complex’ means the entirety of spaces (built-up and unbuilt), located in Muiden at Herengracht 1, that falls under the legal or management authority of the management of the Muiderslot, such as presentation rooms, castle routes, tavern, museum shop, moat, gardens, ramparts, casemate, water shield, jetties, gatehouse, other outdoor areas and the depot.
1.3
By `visitor’ is meant anyone who enters the museum complex and/or visits an exhibition and/or attends an activity organized in the museum complex by the Muiderslot or by third parties with the permission of the Muiderslot. Children up to and including 12 years of age may only enter the museum complex (castle, gardens and activities) when accompanied by an adult.
1.4
‘Admission ticket’ means an entrance ticket (whether or not in combination with a discount card) or a similar proof (such as a written invitation, voucher, annual pass), which provides access to (specified) room(s) in the museum complex of the Muiderslot.
2. Applicability
2.1
The moment a visitor enters the museum complex, either as a paying visitor or as a guest, he is deemed to have entered into an agreement with the Muiderslot to which the Conditions of Visit apply. The visiting conditions are also applicable to special activities within or outside regular opening hours and/or aimed at other than the regular visitor, such as in the case of hall rental, catering, store visits and the like.
2.2
These conditions apply to all visitors to the Muiderslot. They also apply to all natural persons and/or legal entities engaged by the Muiderslot in connection with its objectives.
2.3
Deviations from these terms and conditions are valid only if expressly agreed upon in writing.
3. Accessibility
3.1
The (historic) multi-storey buildings in which the museum complex is located are not accessible to wheelchair users, people with walkers, buggies and baby carriages and also difficult to access for the disabled. However, the courtyard and outdoor area are accessible; wheelchair users do not have to pay an entrance fee for these. Assistance dogs and guide dogs are allowed throughout the museum complex if they accompany a visitor with an identification card.
3.2
Upon entering the museum complex, visitors are advised to be aware of the escape routes to be used in the event of an emergency or threat thereof.
4. Ticket sales, offers, prices and refunds
4.1
All quotations, announcements or otherwise provided by the Muiderslot are not without obligation. The Muiderslot accepts liability for possible errors made by the museum itself in price quotations, announcements or other written information provided to the visitor. This liability is limited to (restitution of) the cost of the admission ticket. The Muiderslot is not liable for errors attributable to intent, fault or negligence of third parties.
4.2
The visitor is obliged at all times to show the admission ticket to officials recognizable as such, such as attendants and tour guides, if requested. The admission ticket gives access to the designated entrances, paths and areas.
4.3
The potential visitor is not entitled to obtain a refund of the admission price or any other compensation in case of loss or theft of the admission ticket before entering the museum complex. If a potential visitor does not use the pre-purchased admission ticket, this is at the visitor’s own expense and risk; this is also the case if the admission ticket is only valid for a specific time and/or date. An admission ticket once obtained cannot be exchanged. There will also be no refund of the admission price. However, the price paid for admission may be refunded if circumstances beyond the buyer’s control make it impossible to visit the museum, but this is at the management’s discretion.
4.4
The potential visitor may be denied access to the museum complex if it appears that the admission ticket was not obtained from the Muiderslot or a body authorized to do so by the Muiderslot.
4.5
The Muiderslot will refund the price of admission actually paid by the visitor only if the visitor has to leave the museum complex prematurely due to an unannounced exercise in the context of the company emergency service, as well as in the event of an actual calamity due to which the museum complex is fully or partially evacuated.
5. Stay
5.1
Visitors are prohibited from remaining in, or going to, any part of the museum complex other than that to which the admission ticket entitles them.
5.2
During his/her stay in the museum complex, the visitor must behave in accordance with public order, good morals and the rules of decency applicable to the nature of the activity visited. The visitor is also obliged to immediately follow the directions and instructions given by identifiable officials of the Muiderslot, such as attendants and tour guides.
If, in the reasonable judgment of a duly authorized official of the Muiderslot, who must be recognizable as such, the visitor violates these standards, directions or instructions in any way, the visitor may be denied further access to the museum complex, without the visitor having any right to reimbursement of the cost of the admission ticket or any other expenses incurred.
5.3
Parents or supervisors of children are at all times responsible for and accountable for the behavior of children they bring with them. Teachers and supervisors of groups are responsible for and accountable for the behavior of group members they supervise.
5.4
Among other things, visitors are prohibited from entering the museum complex:
- offer goods of any kind for sale to third parties, or provide them free of charge;
- intentionally and prolongedly obstruct other visitors’ way or obstruct the view of exhibits;
- inconvenience other visitors, such as through the use of cell phones or other sources of noise pollution; however, the use of such equipment may be expressly permitted by the Muiderslot in certain areas;
- bring (domestic) animals, unless they are official assistance dogs or guide dogs for the blind and accompany a visitor with an identification card;
- smoking on the grounds of the Muiderslot (inside and outside) and/or using fireworks, smoke machines and torches;
- drones to fly over the museum complex;
- food and beverages to be brought into the museum complex;
- in the opinion of an official of the Muiderslot recognizable as such, to carry dangerous objects or substances, such as, walking sticks, umbrellas or large bags; these may be handed in at a place to be designated by the Muiderslot;
- indoor use of wheelchairs, walkers, strollers and baby carriages (this due to the many height differences, see accessibility);
- touching exhibited objects and exhibition materials such as display cases, lighting, partitions and the like, unless expressly and explicitly permitted. Parents or supervisors of children should strictly ensure that exhibited objects are not touched by the children they bring with them. Small children should be held by the hand; similarly, teachers and supervisors of groups shall ensure that the group members they are supervising do not touch the exhibited objects.
5.5
In special cases where the general safety of persons or the collection reasonably so requires, an official of the Muiderslot, who must be recognizable as such, may request inspection of the (hand) luggage carried by the visitor. Furthermore, if deemed necessary, specially trained personnel may request the visitor to cooperate in a security search upon entering or leaving the museum complex.
5.6
A surveillance system is operational at the Muiderslot. Visitors agree that video recordings may be made of it. The recordings are kept in accordance with legal requirements. If necessary, the footage will be made available to the police.
5.7
Other than with prior written permission from the management of the Muiderslot, visitors are prohibited from taking photographs, video and film recordings involving the use of lamps, flash equipment and tripods.
5.8 The museum may deny access to the museum complex permanently or for a certain period of time to a visitor who has intentionally damaged an object during one or more previous visits to a Dutch museum complex, or who otherwise justifies the fear of damage; the museum may in any case subject this visitor to the measures mentioned in Article 5.5 of these Conditions for Visitors during all his visits.
The decision to deny access must be communicated to this visitor without delay and with reasons, if possible in writing.
5.9
The Muiderslot regularly makes photo/film reports of activities in the museum complex. This material can be used for publicity purposes on the website, in leaflets, etc. By entering the museum complex, the visitor agrees to the publication of this material. If the visitor objects to the publication of visual material in which he is recognizable, this can be made known to the Muiderslot. The Muiderslot will then make every effort to prevent publication of the material.
6. Complaints
6.1
The Muiderslot will do everything possible to ensure that a visit to the museum complex or the presentations and activities organized by the Muiderslot take place in accordance with the published offer; this includes the obligation to inform the public to the best of its ability about full, partial or early closure of the museum complex and/or presentations and activities organized by the Muiderslot. Furthermore, the Muiderslot informs the potential public about maintenance work, renovations or the (re)arrangement of spaces that cause nuisance. The visitor can never derive a right to compensation from this.
6.2
Complaints that can never lead to any obligation for compensation by the Muiderslot to the visitor:
- complaints relating to the invisibility of objects from the Muiderslot’s permanent collection;
- complaints related to the partial closure of the museum complex, e.g. partial closure due to exhibition construction or dismantling;
- complaints and circumstances involving nuisance or inconvenience caused by other visitors, such as noise, inappropriate behavior, theft and molestation;
- complaints and circumstances relating to nuisance or inconvenience caused by maintenance work, such as remodeling or the (re)arrangement of rooms;
- complaints and circumstances involving nuisance or inconvenience caused by the improper functioning of facilities in the museum complex.
6.3
Visitors may submit complaints and suggestions in writing by completing a form available at the box office or at info@muiderslot.nl.
6.4
The Muiderslot will investigate the complaint and respond in writing within 30 days of receipt. If the investigation has not been completed by then, the complainant will be notified of this and the probable time when it will be.
7. Liability
7.1
The Muiderslot can never be held liable for damage resulting from price quotations, announcements or other forms of information provided to the visitor by the Muiderslot and/or third parties, except if and insofar as such damage is the direct result of intent or gross negligence on the part of the Muiderslot and/or its employees.
7.2
Visitors’ stay in the museum complex is at their own expense and risk.
The museum is only liable for property and/or consequential damage suffered by the visitor or injury caused to the visitor that is the direct and exclusive result of intent or gross negligence on the part of the museum, whereby only that damage qualifies for compensation for which the museum is insured, or should have been insured in all reasonableness and fairness.
7.3
Under no circumstances shall the Muiderslot be liable to pay a higher amount of compensation than:
- The actual admission price paid and actual travel expenses incurred within the Netherlands or, if more;
- The amount paid by the Muiderslot’s insurer to the Muiderslot in respect of the damage, or;
- the compensation obtained from a third party in respect of the damage.
7.4
For damage caused to the visitor’s vehicles the Muiderslot is never liable except if and insofar as the damage was caused on or in the museum premises and this damage is the direct result of intent or gross negligence on the part of the Muiderslot and/or its employees.
7.5
The Muiderslot is never liable for any (in)direct damage whatsoever, caused as a (in)direct result of any defect, any quality or circumstance to, in or on any immovable property of which the Muiderslot is holder, leaseholder, lessee or owner or which is otherwise at the disposal of the Muiderslot, except if and insofar as the damage is the direct result of intent or gross negligence on the part of the Muiderslot and/or its employees.
7.6
If the Muiderslot takes delivery of goods or if goods are deposited, kept and/or left anywhere in any manner whatsoever by anyone without the Muiderslot stipulating any compensation, the Muiderslot shall never be liable for damage to or in connection with goods in any manner whatsoever unless the damage is the result of intent or gross negligence on the part of the Muiderslot and/or its employees.
7.7
The total liability of the Muiderslot due to attributable failure in the fulfillment of the visit agreement is limited to compensation for direct damage and will in no case exceed the compensation arrangement described under 7.3.
7.8
In the event of damage due to death or bodily injury, the total liability of the Muiderslot will in no case exceed the compensation arrangement described in 7.3.
7.9
Liability of the Muiderslot for indirect damages, including consequential damages, lost profits or wages, missed savings et cetera, is excluded.
7.10
The maximum amounts mentioned in Article 7.3 shall cease to apply if and insofar as the damage is the result of intent or gross negligence on the part of the Muiderslot or any of its officers.
8. Force majeure
8.1
As force majeure for the Muiderslot, which means that any shortcoming caused by it cannot be attributed to the Muiderslot, any unforeseeable circumstance which interferes with the execution of the agreement by the Muiderslot to such an extent that, temporarily or permanently, the execution of the agreement becomes impossible or difficult.
8.2
Under such circumstances are also understood circumstances with persons and/or services and/or institutions which the Muiderslot makes use of in the execution of the visit agreement, as well as everything that applies to the aforementioned as force majeure or suspensive or resolutive condition, as well as attributable shortcomings of the aforementioned.
9. Found objects
9.1
Objects found by the visitor in the museum complex can be handed in at the ticket office.
9.2
The Muiderslot will make every effort to locate the owner or rightful claimant of the found object and will keep in contact with the local police for this purpose if necessary. Found objects will be kept by the Muiderslot for a maximum of one month.
9.3
In case the owner or rightful claimant of a found object comes forward, he/she has the choice of collecting the goods himself/herself or having them sent to him/her, after advance payment of shipping costs. In both cases, the owner or entitled party must provide proper identification.
10. Photos and videos during activities
The Rijksmuseum Muiderslot regularly commissions third-party photo and video reports in and around the castle. This material can be used for PR purposes on the website, in print and other channels. If visitors object to the publication of visual material in which they can be recognized, they can notify the Rijksmuseum Muiderslot. In this case, the Rijksmuseum Muiderslot will make every effort to prevent further publication of the material.
11. Applicable law
11.1
These Conditions for Visitors and the agreement between the visitor and the Muiderslot are governed by Dutch law.
11.2
All disputes arising from the agreement between the visitor and the Muiderslot shall be submitted to the exclusive jurisdiction of the court having jurisdiction in Muiden.
